Terms of Service - ToS
This terms of service agreement is between 'The Artist'(Ribbon Mochi) and 'The Client' (you). It's important for you to read and understand them as you'll be automatically accepting these terms upon purchase.
General
- The Client must read, understand, and agree to all the terms. By continuing with the commission
and proceeding with payment, the Client has agreed to the terms outlined below.
- The Artist reserves the right to refuse a commission without reason or explanation.
- Inappropriate/Aggressive behavior will not be tolerated, should this or a breach of these terms
occur the artist may stop or cancel the commission. This includes poor communication.
- The Artist is not responsible for providing the client with a physical object, print, merchandise,
etc. of the artwork, unless agreed upon, in which a fee may be applied.
- Clients who file a chargeback will be blacklisted and unable to purchase another
commission in future.
-Clients who repeatedly request commissions but do not pay will be blacklisted and unable to
purchase another commission in future.
- By providing the client with a line of communication with the artist, the client agrees to act
in a professional manner.
- The client may not redistribute the artist's identification or contact in any way.
Usage / Rights
- The Artist reserves the right to use any completed commission work. This includes the right to crop,
edit, or alter the commission for promotional use and posting the work to social media. Credit will
be given to the client for any IP/ownership.
- Art may be re-posted by Client on social media with proper credit to the artist
- The Client may not alter or edit the piece of artwork itself unless agreed upon by the Artist.
- The Client may not claim the commissioned piece as created by themselves in any way, shape, or form.
- Commissioned artwork may not be resold.
- Removing any artist's watermarks/signature if included in the art is a direct violation of these terms.
- The Artist may livestream the process of a commissioned work, If the Client does not want their commission to be public/public prior to finishing, this must be communicated clearly when filling out the commission form.
Personal Commissions
Personal commissions (e.g Gifts) are artworks that are made with the intention for private use.
- These commissions can be used for profile pictures, backgrounds and printed for private and
personal use, with appropriate credit given where possible.
- Personal commissions cannot be used for advertising or generate profit.
Commercial commissions
Commercial commissions (e.g logos, animations, advertising, twitch assets.) are artworks that are
made with the intention to promote and sell products or services.
- The client is able to use this art for streaming and advertising. Artwork must still be credited
whether in video description, or somewhere on a streaming service page. If the art is intended
to be used for the sale of products this may incur additional fees and credit is still required.
- Commercial use fees will be added to commission price, the client must communicate clearly what
the work will be used for so that this price will be reflected accurately.
Payment
- All prices are listed in USD (United States dollar).
- Payments must be made with Paypal or via Kofi, prices are tax inclusive.
- Full cost of the commission is required up front before the artist will begin work on the commission.
- Prices listed on the commission page are a 'base price', this is subject to change according to size, complexity and/or detail of the piece at the discretion of the artist.
- Invoices are required to be paid in full within 7 days of sending them. The Artist will not begin
work on the commission until payment has been received.
- A group commission must be paid for by 1 (one) person in order to avoid complications.
- If the commission is needed by a specific deadline, this needs to be communicated to the artist
in advance, otherwise the artist may apply a fee at their discretion to complete the work in time.
- Final price stated by the artist are non-negotiable.
Process
The general process for commissions is as follows:
- Client requests commission
- The artist accepts commission
- Invoice is sent.
- The client sends full payment via paypal
- The artist starts work on commission
(during this time changes can be made at cost, and updates can be requested)
- The client receives commission files.

-The Client must provide clear and concise references of their characters in order to avoid confusion.
If the Client does not have visual references of their character an additional fee may be applied for
creating character design.
-Digital art is a digital file and nothing will be physically sent/mailed to the client.
-Any written text or communication must be in English.
- Allow for between 2-4 weeks for commission turnaround. This depends on many factors such
as complexity of commission, artist health, and Work/family issues. If any of the previous mentioned
events will affect the commission process, the client will be notified and refunded if necessary. The
Client will be notified of an approxmiate timeline.
Changes
- Client can request updates on their artwork(s) once a week maximum. Updates will be sent
as soon as the artist is able.
- Clients may request changes prior to lineart. A maximum of two (2) minor changes can be made
during the early stages of the commission without cost to the client.
- Changes must be clear, as they will only occur once (Client can not ask for a change, then ask for
the artwork to be returned to state prior to the change.) Major changes applied after this initial
stage may require an extra fee based on the nature or complexity of the change.
- Major changes include: Character design changes such as background or pose changes,
adding/removing characters and objects.
- Minor changes (that do not incur fees) include: Colour changes, lighting changes, minor things
that may have been missed from a reference.
Fees for Major changes may cost up to 50% of the original commission price at the discretion of the artist.
Refund Policy/Other
- If the Client wishes for a refund after the Artist has started the work, a refund will not be given. No exceptions.
- If a chargeback is charged against the artist by the client, the rights of the commission will be
redacted from the client. the artist holds the right to file a complaint if necessary.
